POLICE EFFORTS IN OVERCOMING THE THEFT WITH VIOLENCE IN SOUTH NIAS DISTRICT

Abstract

One important element in creating security and order to provide protection, service, and protection for the community is the Police. The jurisdiction of the South Nias Regional Police covers 32 sub-districts. Such conditions have an impact on the role of the South Nias District Police, especially in handling criminal acts of theft with violence that are prone to occur in the jurisdiction of the South Nias Regional Police. The problems studied are: 1) how is the regulation of criminal acts of theft with violence according to criminal law? 2) what are the factors that can lead to criminal acts of theft by violence in the jurisdiction of the South Nias Regional Police? 3) what is the role of the South Nias Police Station against theft by violence in its jurisdiction?


      Research method used is normative juridical and the type of this research is analytical descriptive. The sources of data in this study are primary through document studies at the Nias Selatan Police Office and secondary data obtained from literature studies on primary legal materials and secondary legal materials.


      The results of the study indicate that the discussion of the problem of the regulation of criminal acts of theft by violence (Curas) is regulated in Article 365 of the Criminal Code. The arrangement is confirmed in a special form, namely theft by violence (Curas) or robbery. Violence in theft is carried out simultaneously when a criminal act is committed and directed at people as victims not to objects or goods other than people. If more than one person is carried out together, the sanctions are aggravated or carried out at night, in emergencies, in crowds, etc.. The factors that can lead to the occurrence of curas in the jurisdiction of South Nias District Police are gathered in many factors and these factors also become criminogenous crimes if no preventive or preventive steps are taken. The extent of the Nias Selatan District Police jurisdiction in handling 32 sub-districts at the same time is not comparable to the capabilities of facilities and infrastructure as well as South Nias District Police personnel. The role of the South Nias District Police against theft by violence in its jurisdiction is carried out based on the provisions of the laws that apply to determine the Police as protectors, protectors, and servants of the community and act as law enforcement officers. As law enforcement officers, Nias Selatan District Police investigated and investigated all violations and any crimes or criminal acts such as theft until the completion of these cases. South Nias National Police prioritizes handling of Curas and other crimes classified as prominent cases (Crime Index). Based on the data presented above, the handling of the South Nias Police Station against theft is low and can be resolved from the cases that have been identified.
