MEKANISME PEMBATALAN PATEN SEDERHANA (STUDI PUTUSAN PENGADILAN NEGERI JAKARTA PUSAT NOMOR : 61/PDT.SUS-PATEN/2018/ PN.NIAGA.JKT.PST JO. PUTUSAN KASASI NOMOR : 802 K/PDT.SUS-HKI/2019)
Abstract
Pemberian hak paten melindungi penemuan teknologi yang dibuat oleh manusia. Dasar paten memegang peranan penting dalam kemajuan industri. Persaingan pasar internasional dipengaruhi oleh perkembangan pasar nasional yang dipengaruhi oleh globalisasi persaingan industri. Dua hal yang menjadi perhatian utama kajian ini adalah apakah mungkin untuk meminta pembatalan suatu Paten sederhana yang telah didaftarkan dan apakah putusan Pengadilan Niaga No. 61/Pdt.Sus-Paten/2018/PN.Niaga.Jkt.Pst mematuhinya. Undang-Undang Nomor 13 Tahun 2016 tentang Paten. Metode penelitian yang digunakan adalah inferensi deduktif, analisis data deskriptif kualitatif, dan yurisprudensi normatif dengan menggunakan data sekunder. Temuan penelitian menunjukkan bahwa, sesuai dengan Undang-Undang Nomor 13 Tahun 2016 tentang Paten, Pasal 130, suatu paten yang telah didaftarkan dapat dimintakan pencabutan pendaftarannya apabila dibatalkan karena hukum, atas permintaan, atau melalui perbuatan hukum. Putusan majelis hakim Pengadilan Negeri Jakarta Pusat Nomor 61/Pdt.Sus-Paten/2018/PN.Niaga.Jkt.Pst yang menyatakan “gugatan para pemohon tidak dapat diterima” karena “kurangnya tuntutan” adalah salah karena hakim hanya memperhitungkan Pasal 10 ayat 1 (2) UU Nomor 13 Tahun 2016 dan mengabaikan Pasal 12 ayat (1) dan (2) UU Nomor 13 Tahun 2016.

Abstract
Patent rights protect technological discoveries made by humans. Patents play an important role in industrial progress. International market competition is influenced by the development of national markets which are influenced by the globalization of industrial competition. The two main concerns of this study are whether it is possible to request permission for a simple patent that has been registered and whether the Commercial Court decision no. 61/Pdt.Sus-Paten/2018/PN.Niaga.Jkt.Pst comply. Law Number 13 of 2016 concerning Patents. The research methods used are deductive inference, qualitative descriptive data analysis, and normative jurisprudence using secondary data. Research findings show that, in accordance with Law Number 13 of 2016 concerning Patents, Article 130, a patent that has been registered can be requested to have its registration revoked if it is canceled by law, upon request, or through legal action. The decision of the panel of judges at the Central Jakarta District Court Number 61/Pdt.Sus-Paten/2018/PN.Niaga.Jkt.Pst which stated "the petitioners' lawsuit cannot be accepted" due to "lack of demands" was because the judge was wrong to only convey Article 10 paragraph 1 (2) Law Number 13 of 2016 and ignoring Article 12 paragraphs (1) and (2) Law Number 13 of 2016.
