PENGATURAN KLAUSULA BAKU PADA JUAL BELI ONLINE

Abstract
This research discusses the policy of standard clauses in the Consumer Protection Act (UUPK) in relation to online buying and selling activities, especially through e-commerce. In the delivery of products purchased online, the phrase "does not accept any complaints, without being accompanied by an unboxing video" is often found on the shipping box received by consumers. This is a provision that is only unilaterally determined by business actors and must be fulfilled by consumers. In general, the position of consumers in buying and selling is quite vulnerable to losses, including in online buying and selling transactions where consumers cannot first assess the quality of the goods they will receive. Based on normative juridical research, this research is examined using Consumer Protection Act (UUPK) as a supporting research. There is a clause provision that states that business actors are prohibited from forcing submission to regulations in the form of new rules unilaterally made by business actors and prohibitions on the transfer of business actor's responsibility.

Penelitian ini membahas mengenai kebijakan klausula baku pada Undang-Undang Perlindungan Konsumen dikaitkan dengan kegiatan jual beli online, khususnya melalui e-commerce. Dalam pengiriman produk yang dibeli melalui online seringkali ditemukan frasa “tidak menerima komplain apapun, tanpa disertai video unboxing” pada kotak pengiriman yang diterima oleh konsumen, yang mana hal tersebut merupakan suatu ketentuan yang hanya ditetapkan secara sepihak oleh pelaku usaha dan bersifat wajib dipenuhi oleh konsumen. Secara umum posisi konsumen pada jual beli sendiri terbilang cukup rentan mengalami kerugian, termasuk juga pada transaksi jual beli online dimana pihak konsumen tidak bisa menilai lebih dulu terkait kualitas dan kesempurnaan dari barang yang akan diterimanya. Berdasarkan dengan penelitian yuridis normatif, penelitian ini dikaji dengan menggunakan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen sebagai penunjang penelitian. Terdapat ketentuan klausula yang menyebutkan larangan bahwa pelaku usaha dilarang untuk memaksakan ketundukan kepada peraturan yang berupa aturan baru yang dibuat secara sepihak oleh pelaku usaha dan larangan mengenai pengalihan tanggung jawab pelaku usaha. Dimana seharusnya pelaku usaha tidak boleh melepaskan tanggung jawab begitu saja dalam menangani keluhan mengenai produk yang diberikan oleh konsumen.
